Terms of service
Article 1 — Purpose and scope
These general terms and conditions of sale govern all sales concluded on the site kups.ma between Kup's, a single-shareholder limited liability company (SARL AU) with share capital of MAD 100,000.00, whose registered office is at Zone Industrielle Oulad Saleh, Lot 175 RDC, 25108 Oulad Saleh, Casablanca, registered with the Casablanca Trade Register under number 689479, ICE 003693693000063, reachable on +212 6 63 28 83 34 and at contact@kups.ma, hereinafter "KÚPS", and any person making a purchase on the site, hereinafter "the Customer".
Placing an order implies unreserved acceptance of these terms. KÚPS reserves the right to amend them at any time; the terms applicable are those in force on the date of the order.
Article 2 — Territory
Online sales are restricted to the territory of the Kingdom of Morocco. No order is shipped abroad.
Article 3 — Products
KÚPS sells specialty coffees, teas, infusions and spices, loose or packaged.
Products are presented with the greatest possible precision: origin, region, producer or cooperative, altitude, processing method, tasting score and aromatic profile. Some of this data is provided by producers.
Coffee is an agricultural product: slight variations in appearance, colour or profile between two lots of the same origin are normal and do not constitute a defect of conformity.
Products are offered subject to available stock. A sold-out product remains visible on the site but cannot be added to the basket.
Article 4 — Prices
Prices are shown in Moroccan dirhams (MAD), inclusive of all taxes. They do not include delivery charges, which are billed separately and shown before the order is confirmed.
The price of a coffee is identical whichever grind is chosen; it varies only by weight.
KÚPS reserves the right to change its prices at any time. Products are invoiced on the basis of the rate in force at the time the order is validated.
Article 5 — Orders
Creating a customer account is not required: orders may be placed as a guest.
The ordering process comprises product selection, basket review, entry of delivery details, choice of payment method and final validation. Validation constitutes acceptance of the price and of these terms.
A valid telephone number is mandatory: every order is confirmed by call or message before dispatch. If the Customer cannot be reached, dispatch is suspended and the order may be cancelled.
KÚPS reserves the right to refuse or cancel any order of an abnormal nature, in particular in the event of a previous dispute or manifestly incorrect details.
Article 6 — Payment
Two payment methods are offered:
- Cash on delivery, with no ceiling: payment is made in cash when the parcel is handed over;
- Card payment, processed by an approved banking provider.
No banking data is collected, processed or retained by KÚPS. Card payment operations are handled entirely by the banking provider, in a secure environment.
Article 7 — Delivery
Deliveries are made to the address given by the Customer when ordering, anywhere in Morocco.
Delivery charges amount to 35 MAD and delivery is free from 500 MAD of purchase.
Stated timings are indicative and run from confirmation of the order. A delivery delay cannot give rise to cancellation of the sale or to damages, save for fault on the part of KÚPS.
It is the Customer's responsibility to check the condition of the parcel on receipt and to report any anomaly promptly.
In-store collection is not offered.
Article 8 — Right of withdrawal and returns
In accordance with Law No. 31-08 laying down consumer protection measures, the Customer has seven days from receipt to exercise their right of withdrawal, without having to give reasons or pay a penalty.
For reasons of hygiene and food safety, this right may be exercised only on products that are unopened and in intact original packaging. An unsealed bag cannot be taken back.

Article 9 — Warranty and conformity
In the event of a non-conforming or damaged product, or a dispatch error, the Customer contacts KÚPS at contact@kups.ma. After verification, KÚPS replaces the product or refunds it, with return costs borne by KÚPS.
Article 10 — Personal data
The data collected is necessary to process orders. Its processing is described in the privacy policy, in accordance with Law No. 09-08.
Article 11 — Intellectual property
All elements of the site remain the exclusive property of KÚPS. No reproduction is permitted without prior written agreement.
Article 12 — Force majeure
KÚPS cannot be held liable for failure to perform its obligations arising from an event of force majeure, in particular interruption of transport, natural disaster, fire or administrative decision.
Article 13 — Applicable law and disputes
These terms are governed by Moroccan law. In the event of a dispute, the parties will seek an amicable solution. Failing that, jurisdiction is attributed to the courts of Casablanca.
